I don't think there is anything wrong with the brake, if it works with your button.
It depends mostly on whether you have a green "push-to-operate" or a yellow "traction lock override" button, to determine what the problem is.
If the button is green, you have a switch in your seat bar pivot, and the seat-switch is by-passed. Check the seat bar switch. Sometimes they loosen or wear and they pivot with the bar.
If the button is yellow, you also have a seat switch under the seat. Any objects or dirt that keeps your seat from moving downward with you in it will cause a malfunction. You can get an update "push-to-operate kit" and take care of this PIA, but it's like $300 I think.
Simplest is, according to your description, you are starting with the bar up, hitting the button, then lowering the bar, which I believe re-sets the system and drops the brake.
